U.S. Attorneys Mixup

Main article: Dismissal of U.S. Attorneys controversy

The governing statute, 28 U.S.C. § 546 provided, up until March 9, 2007:

(c) A person appointed as United States attorney under this section may serve until the earlier of—

(1) the qualification of a United States attorney for such district appointed by the President under section 541 of this title; or
(2) the expiration of 120 days after appointment by the Attorney General under this section.

(d) If an appointment expires under subsection (c)(2), the district court for such district may appoint a United States attorney to serve until the vacancy is filled. The order of appointment by the court shall be filed with the clerk of the court.

On March 9, 2007, President George W. Bush signed into law the USA PATRIOT Act which amended Section 546 by striking subsections (c) and (d) and inserting the following new subsection:

(c) A person appointed as United States attorney under this section may serve until the qualification of a United States Attorney for such district appointed by the President under section 541 of this title.

This, in effect, extinguished the 120 day limit on interim U.S. Attorneys, and their appointment had an indefinite term. If the president failed to put forward any nominee to the Senate, then the Senate confirmation process was avoided, as the Attorney General-appointed interim U.S. Attorney could continue in office without limit or further action. Related to the dismissal of U.S. attorneys controversy, in March 2007 the Senate and the House voted to overturn the amendments of the USA PATRIOT Act to the interim appointment statute. The bill was signed by President G.W. Bush, and became law in June 2007.

In other words, our lovely Congressmen took even their own rights away in the USA PATRIOT Act. As soon as someone realized what the hell just happened, they scrambled to strike out the idiotic amendment-- and did so three months later.

These are the people running our country....

I've heard people say that, if you anthromorphized a corporation into an actual human being, a corporation could be diagnosed as a sociopath: able to mimic social compassion, but always focused on self-fulfillment no matter the consequence to others.

Apply the same process to a government, and the person can only be described as a schizophrenic. They may hold some meaning and understanding to a higher ideal, but is too dysfunctional to ever resolve that goal.

Dark Spark, that's a wonderful thought. I love that.

Although, schizophrenic people usually have tremendous IQs.

The real trouble is the instability of a government. The objectives are ever-changing, depending on the needs and wants of the individual wielders of a particular power. They may change their mind in order to preserve their position. Or they may hold their ground and be replaced by another who holds a different view.

Hard to build a castle made of ideas when the foundation of resolve shifts with every turn of the wind.

The key is to find the right stones that will not flutter in a breeze, nor be toppled by a brief gust. That is what separates a republic from a democracy.

Our government is pretty immune to that, what with one term in the senate being a whole 6 years, but the problem that issues is term after term after term of these old, eventually backwards senators that try their damnedest to hold onto Traditional Values™.

I think your senators and congressmen are actually pretty intelligent and know full well what they're doing. They know it's wrong to cling onto this "traditional value" bull [&@%!] all the time, but are doing so to secure the "stupid" vote as I like to call it. Pricks, but intelligent.

I think it demands a bit more dedication than that. They might know what's really going on, but they've at least managed to convince theirselves that they're what's standing in between the country and anarchy.

At any rate, that's even worse, because instead of being genuinely outdated, you're a [&@%!] amoral, unethical, hypocritical liar.

I agree with you, I always hated on Sarah Palin because of what she does, but damn does she do it well (Jedi Mind Tricks). She preaches to the dumb-dumb crowd what they want to hear. The dumb-dumbs of America are like the dumb-dumbs across the world; repeaters. They repeat what their father told them. They have no interesting opinions, and will take facts and twist them for support of their beliefs. They want to be the "good guys," all the while their intellectual laziness makes them the bad guys.

Ain't that a B?

Luckily we don't have to go that far, since corporations are already people:

She does. But isn't it refreshing that for once a politician is honest and sincere in their pandering to the base? Unlike say, Romney, who has to parrot Tea Party positions to try and squeeze a few votes out of people who know he's full of it, Palin actually believes the hooey she peddles to America's redland rubes. She's one of them, and the crowd responds with its characteristic pleased grunts of herd recognition.

Actually, Will (you might already know this) but in law, corporations are people:
Despite not being natural persons, corporations are recognized by the law to have rights and responsibilities like natural persons ("people"). Corporations can exercise human rights against real individuals and the state, and they can themselves be responsible for human rights violations. Corporations are conceptually immortal but they can "die" when they are "dissolved" either by statutory operation, order of court, or voluntary action on the part of shareholders. Insolvency may result in a form of corporate 'death', when creditors force the liquidation and dissolution of the corporation under court order, but it most often results in a restructuring of corporate holdings. Corporations can even be convicted of criminal offenses, such as fraud and manslaughter. However corporations are not living entities in the way that humans are.

Does that make Microsoft our alcoholic uncle then?

I want to see just how far someone could take this in court... "What did you say Oscar Meyer did to you?" "He/she attacked me with an onslaught of wieners!"

Theoretically, that is possible, yes.

To elaborate: Let's say a man had been beaten by an employee of a corporation. If it was the interest and directive of the corporation that had driven the employee to beat the man, then the corporation could be charged with provoking an aggravated assault.

So does the corporation wait in jail for its bail hearing?

Yeah, but pandering to a group of the most sexist individuals in America doesn't work great for getting a woman elected.
