If it's banned, it's technically a crime.
I.E. In some states in the US it's banned to own lock picks without being a locksmith, they can arrest you for possession.
Cocaine is banned.
Heroine is banned.
Marijuana is banned.

The Mage's Guild may not like it, and they may ban it WITHIN (i.e, they won't have any members who practice Necromancy) the Mage's Guild, but they can't make laws. That is what the (presumably) Council is for.

To the above (Kestral), sure, Marijuana and Cocaine and other illegal narcotics are BANNED, but that is by the (U.S) GOVERNMENT, not just... well... I can't think of anything to compapre the Mage's Guild in real life but still!

Note: Please, I am not capitalising some words to be offensive or sound angry, I'm just capitalising because I want to put emphasis on it (I'm too lazy to use the bold tags).

But more on topic, if by 'crimes' you mean things that increase your bounty, then you can think of breaking out of jail as a crime since it increases your bounty by 50.
